Terms and Conditions

  1. Basic information
    1. Website Operator: Kutaj Group s.r.o., ID: 21670315, (hereinafter also referred to as "EleganceBet", "we", "us", "our") operates the website https://elegancebet.cz/ (the "Site") and provides the services described below.
    2. Service provider: the service provider is the company Kutaj Group s.r.o., ID No.: 21670315 (hereinafter also referred to as "EleganceBet", "we", "us", "our") .
    3. Customer: a customer is any person who registers on the Service Provider's website and/or orders the Service Provider's services.
    4. Services: the Service Provider provides advisory services in the field of sports betting on sports matches and other sporting events (hereinafter referred to as "EleganceBet Services" or "Services").
  2. Our services
    1. EleganceBet offers customers packages containing tip analysis, betting advice and special offers as listed on the site.
    2. Packages:
      • Entry Package: 7 picks/predictions for 7 days, betting advice, priority access to special offers.
      • Upgraded package: 7 picks/predictions for 7 days, betting advice, priority access to special offers.
      • Luxury package: 30 tips/predictions for 30 days, advice on opening an account with a bookmaker, priority access to special offers.
      • Single ticket: 1 ticket/prediction, delivered on the day of purchase.
    3.  All prices for services are inclusive of taxes and fees.
  3. Nature of services
    1. The services provided by EleganceBet are informative in nature and are not guaranteed advice. The customer uses the information provided at his/her own risk. The service provider does not guarantee the success of a bet if the customer follows the advice, recommendation or consultation provided.
    2. The Service Provider shall not be liable for any loss or damage arising from the use of the tips, advice or strategies provided.
    3. The service provider does not place bets on behalf of the customer and does not accept money for betting.
  4. Prices and payments
    1. The price of services is set separately for the respective service offered.
    2. The price of the services includes delivery costs and any fees associated with the chosen payment method.
    3. Prices are final, including all taxes and fees.
  5. Discounts
    1. Any discounts on the price of the services provided by the service provider cannot be added together or combined, unless the customer and the service provider agree otherwise.
  6. Conclusion of the contract
    1. The conclusion of the contract is always based on the customer's order via the website https://elegancebet.cz
    2. The process of ordering services is described in the membership section - https://elegancebet.cz/clenstvi/
    3. The order can be made via the web. Upon successful completion of the order, the customer will receive a confirmation and invoice by email.
    4. The contract is concluded by sending the order confirmation.
    5. The price of the services is payable on the day of conclusion of the contract.
    6. The services will be made available to the customer upon payment of the service price.
  7. Termination of contracts
    1. If the customer fails to pay the price of the services within 3 days after the price of the services is due, the contract is cancelled from the beginning.
  8. Customer rights and obligations
    1. The customer is obliged to provide true and up-to-date information and to keep their login details secure.
    2. The customer is obliged to pay the price of the services.
    3. The Customer is not entitled to provide tips, advice, consultations or any other information provided by the Service Provider to third parties.
    4. Customers may cancel their account at any time by sending a request to info@elegancebet.cz. Upon cancellation of the account, the Customer will lose access to all purchased services and order history.
  9. Contractual penalties
    1. If the customer violates the obligation defined in Article 8.3. of these General Terms and Conditions, i.e. if the customer discloses to a third party information that was provided to him/her within the ordered service (especially if the customer mediates the provided tip, consultation or advice to a third party), the customer is obliged to pay a contractual penalty of CZK 50,000 to the service provider.
    2. All contractual penalties under these General Terms and Conditions are payable within five (5) days of the date on which the Customer receives a written demand from the Service Provider for payment. In the event that the written demand for payment of the contractual penalty fails to be delivered to the customer, the contractual penalty shall be due and payable within ten (10) days of the date on which the written demand for payment is given by the service provider to the postal licensee for delivery.
    3. Payment of the contractual penalty shall not affect the right to compensation for damages in excess of the contractual penalty paid.
  10. Competitions and special offers
    1. EleganceBet may offer competitions and special promotions. The terms and conditions of these offers will always be listed on the website.
    2. EleganceBet reserves the right to change or terminate competitions without prior notice.
  11. Customer account
    1. The customer has access to order history and purchased services through their customer account on the website.
    2. Access data must be secure and must not be shared with third parties.
  12. Right of withdrawal
    1. The customer has the right to withdraw from the contract within 14 days of the conclusion of the contract without giving reasons if the provision of services has not yet begun.
    2. By agreeing to these General Terms and Conditions, the customer, when placing an order, agrees and expressly requests the service provider to start providing the services immediately after the conclusion of the contract, i.e. the customer expressly requests the provider to start providing the services before the expiry of the statutory consumer withdrawal period of 14 days from the date of conclusion of the contract.
    3. In view of the nature of the services provided, as well as the above, with reference to the provisions of Section 1837 of Act No. 89/2012 Coll., the Civil Code, the customer does not have the right to withdraw from the contract in the event that the services are provided (or does not have the right to withdraw from the contract to the extent that the services have already been provided).
    4. Services are provided at the time the tips, advice, recommendations or other purchased information is made available to the customer.
  13. Rights from defective performance
    1. The customer is entitled to the rights from defective performance according to the provisions of § 1914 to § 1925, § 2099 to § 2117 and § 2158 to § 2174 of Act No. 89/2012 Coll., the Civil Code.
    2. Complaints about the services provided can be made by the customer via the e-mail address info@elegancebet.cz. The service provider is obliged to settle the complaint without undue delay, but no later than 30 days from the date of receipt of the complaint with all statutory requirements.
    3. A failed bet made on the basis of a tip, advice or consultation is not a reason for complaint, i.e. a defective performance.
  14. Liability of EleganceBet
    1. EleganceBet will not be liable for any loss or damage resulting from the use of the information provided.
    2. The website contains a complete list of services offered to the customer, including their description and prices.
  15. Awareness and consent of the customer to the terms and conditions
    1. Upon registration as well as for each order placed by the customer on the service provider's website, the customer is informed of these terms and conditions, and by completing the registration as well as by placing the order, the customer agrees to these terms and conditions.
    2. The Terms and Conditions are an integral part of every contract concluded.
  16. Legal order
    1. The rights and obligations between the service provider and the customer are governed by the law of the Czech Republic, even in the presence of an international element.
  17. The Salvator Clause
    1. If any provision of the Terms and Conditions, the Contract or any other arrangement between the Service Provider and the Customer is or becomes or is found to be invalid, void or unenforceable, this shall not affect the validity and enforceability of the remaining provisions of the Terms and Conditions, the Contract or any other arrangement. In such cases, the parties shall be obliged to replace the invalid, void or unenforceable provision with a valid and enforceable provision which shall, to the fullest extent permitted by law, have the same meaning and effect as was intended by the provision to be replaced.
  18. Prorogation
    1. All disputes arising from contracts concluded between the service provider and the customer will be decided by the courts of the Czech Republic. The local jurisdiction of the court shall be determined by the registered office of the service provider.
  19. Effectiveness of the Terms and Conditions
    1. These terms and conditions are valid and effective from 21.6.2024.
